Total and permanent disability (TPD) claims

What is the difference between “Own Occupation” and “Any Occupation”?

Own Occupation definition is based on the criteria that you cannot perform the duties in your own occupation. This definition provides you with the highest opportunity of a successful claim, which is reflected in the higher premiums. This definition is also only available to certain occupation categories.

Any Occupation definition is much harder to meet as you need to be rendered not only to be unable to work in your own occupation, but also any occupation reasonably suited to you by education, training and experience. The advantage of this type of definition is that it offers an alternative to the occupations who cannot access the own occupation definition, the premiums are generally lower, and the policy can be owned under superannuation, allowing premiums to be funded from your superannuation funds.

Do I need to go to a lawyer to claim on TPD?

The short answer is no. We see many advertisements with a “no win no fee” offer on TPD Claims. We have had several clients engage a lawyer for their claims, which have resulted in a win, however the fees can be considerably high, with one client losing $70,000 out of a $100,000 payout in legal fees.

What makes Financial Framework so good at TPD claims?

This type of claim is a specialised area, in which we have had a great amount of success. We provide an upfront quote on costs, so that you have no surprises in the future. We also have a “no win no fee” policy with TPD Claims, however the difference between us and a typical lawyer is the cost. There is a great deal of work involved in preparing and presenting a TPD Claim. These hours will quickly add up and so will your final bill from a lawyer. We are insurance specialists with extensive product and industry knowledge, as well as a wide network of industry contacts. Whereas lawyers are typically standing on the outside of our industry and might not have the same level of experience working with these cases. Therefore we can generally process these claims quicker, in a shorter period of time and at a fraction of the cost.
